State ordered to compensate cannabis cafe owners for lost income.

The government should pay damages to cannabis cafe owners in the south of the country who lost income when the government forced them to become member-only clubs, a court in The Hague has ruled.

The court said clients of coffee shops in Limburg, Noord-Brabant and Zeeland were unwilling to register as official cannabis users, leading to declining turnovers.

The case was brought by the Dutch cannabis retailers' association. Marijuana is not legal in the Netherlands but police turn a blind eye to the possession of up to five grammes for personal use. Cannabis cafes are licenced by their local authority to sell small amounts of the drug.

Tourism

The government hoped by turning the cafes into clubs, drugs tourism would be reduced because only people who officially live in the Netherlands would be able to join.

The club rule operated in the southern provinces between May 1 and November 19 last year, when it was abandoned. Cafe owners said they had lost up to 90% of their clientele because of the new rules.

A second court procedure will determine how much compensation should be paid, The Hague court said in its ruling.

Ban

However, the court did rule the government is within its rights to ban tourists from the coffee shops and that this does not conflict with European legislation.

The cannabis retailers' association plans to appeal against this ruling, as does justice minister Ivo Opstelten.

Peter Hendriks, owner of coffee shop Skunk in Sittard, welcomed the court's decision on compensation. He claims to have lost 75% of his clients and says many have not returned since the registration requirement was dropped, news agency ANP reported.

A reliable source confirmed a theory of mine - some coffee shops supplied some of the street dealers. Remember, no 5 gram limit...hmm, then there's that. So, how much should coffee shops be compensated for "loss"? 1 Euro...

lets look at a bigger picture, if the courts rule, and that compensation gets paid. That would be a big black eye for the prohibitionist's. Compensation paid to a " what basically is an illegal enterprise" from a government that maintains the illegal status, but turns a blind eye, who could wright this. If one member of the European Union would legalize weed, the ruling that allows the government from blocking sales to tourist would be over turned. What kind of stupid theory is that? The government is happy to take the taxes earned from this "illegal enterprise" in the first place. The grey area this industry exists in doesnt mean people should be deprived of their (semi) legal livelihood.

Sorry, Ron may have an unusual tone, but he only voiced an opinion... Something that this forum and others like it are meant for... He attacked no one on here, and whether right or wrong he had a right to say it... His tone bothered me in no way!

I notice when there is a real arse on the forum, (Veggie, Big C, Draught,etc...), very few of you seem to mind, yet Ron, who has been nothing but calm and helpful(tone shouldn't matter since tone is very hard to pick up on in text) get's both barrels.

ron has a ridiculous rather than unusual tone, but still has every right to express any opinion he cares to. i, as a fellow poster, have every right to ridicule him for it. i am pleased that his tone bothered you in no way.

please provide a link to your definition of a real arse. just naming posters that you don't like isn't good enough. you seem to have no trouble at all picking up tone from text, you mentioned earlier that ron's tone hadn't bothered you.

in my post to you i addressed many of your points, answered questions and made an attempt to indicate why i will not just sit still for ron's disinformation. your post was poorly thought out and filled with second hand whiny internet rubbish, you didn't even answer the most salient question in my post, the one about why my disagreeing with ron should exclude me from replying to him.
