Hmm.. if there's no legal/criminal aspect, you could get into the UN declaration of Human Rights - articles 23 and 24 relate to work. The US constitution also guarantees the 'pursuit of happiness' but not the happiness itself (yes some idiot tried that in court). If you've a load of money or a good pro-bono lawyer, you could have some fun.

I can think of a very large US corporation who expanded on their UK presence. Without going into specifics, the nature of their new venture gave them no choice but to employ drug takers (kind of arty/media business). Their normally rigid drug policy/dress code etc was quietly left at home.
