Smokers Want an Exception to be Made for Small Cafes Smoking Ban

A number of smokers organisations are preparing to take the Dutch state to court in order to try to get an exception to be made for small cafes so they won’t fall under the smoking ban.
The smokers clubs are worried that small cafes won’t survive after the smoking ban to be introduced on July 1st. “Larger cafes can build a smoking room area. It is then obvious that customers will choose that cafe over one where they can’t smoke in”, said the spokesman from Forces Nederland, one of the organisations.
The spokesman pointed out that in Ireland and Scotland there have been many small bars and cafes that have had to close down due to the smoking ban. “It is unfair because small businesses don’t have the money or room to survive the consequences of the smoking ban. In Denmark for instance, the smoking ban only applies to cafes that are more than 40 square metres in size”, said the spokesman.

, I don't know if it'd work, however can't the CS's make themselves into a 'Club' (you have to be a member) and get round the 'law' that way ? That's what you can do in many countries, you have to join by paying a member fee on the door, then you're in a 'Private' club. The CS could then give you your 'fee' back in the form of........(use your imagination here).
