Health Canada Warns Medical Pot Producers

Health Canada released a long-anticipated letter to Licensed Producers this week regarding how those approved under the MMPR are allowed to market their products. As a follow-up to the advertising bulletin sent out to Producers on June 30, 2014, which re-iterated the aspects of the Food and Drugs Act (FDA) and Narcotics Act (NCR), the warning letter gives producers until January 12th to comply with these industry standards.

The MMPR, which falls under the FDA and NCR, prevents producers of medical marijuana in Canada from marketing their products directly, or from advertising specific medical effects. What exactly this will mean for Producers who wish to have an online presence still remains to be seen, but some speculate that product and facility images on social media like Twitter and Facebook will now be forbidden. If social media presence is allowed, it may be limited to very bland statements and comments about price, supply, etc. Since many patients interact with their producer via social media, hopefully producers are not regulated off of these platforms entirely.

“As a result of these prohibitions, the information provided by licensed producers to the public should be limited to basic information for prospective clients such as the brand name, proper or common name of the strain, the price per gram, the cannabinoid content, and the company’s contact information”, instructs the Health Canada warning.

These regulations bring Medical Marijuana Producers under the MMPR in-line with pharmaceuticals in Canada, who are not allowed to advertise. Although Medical marijuana in Canada is not an approved “drug” as it lacks a Drug Identification Number (DIN), it is still regulated the same as prescription drugs. Mentions of specific medical benefits (“treatment, preventative or cure”) of cannabis strains will also likely be prohibited, so your LP may no longer be able to tell you what strain is found to be beneficial for what specific medical condition.

From Health Canada’s June 30th letter:

“The Marihuana for Medical Purposes Regulations (MMPR) define advertisement, as does the Food and Drugs Act (FDA) and the Narcotic Control Regulations (NCR), to include any representation by any means whatever for the purpose of promoting directly or indirectly the sale or disposal of a drug in the case of the FDA, or a narcotic with respect to the NCR. The FDA and the NCR contain general prohibitions against the advertising of marijuana that Licensed Producers are required to comply with including, but not limited to:
FDA s 3. (1) No person shall advertise any food, drug, cosmetic or device to the general public as a treatment, preventative or cure for any of the diseases, disorders or abnormal physical states referred to in Schedule A.
FDA s 9. (1) No person shall label, package, treat, process, sell or advertise any drug in a manner that is false, misleading or deceptive or is likely to create an erroneous impression regarding its character, value, quantity, composition, merit or safety.
NCR s 70. No person shall (a) publish or cause to be published or furnish any advertisement respecting a narcotic unless the symbol “N” is clearly and conspicuously displayed in the upper left-hand quarter thereof or, if the advertisement consists of more than one page, on the first page thereof; (b) publish or cause to be published or furnish any advertisement to the general public respecting a narcotic; or (c) advertise in a pharmacy a preparation referred to in section 36.
“Pursuant to subsection 3(1) of the FDA, it is prohibited to advertise any drug to the general public as a treatment, preventative or cure for any of the diseases, disorders or abnormal physical states referred to in Schedule A to the FDA.”

Perhaps the Producers can have a link to a completely independent website that can spell out the beneficial properties of different strains. I feel sure people do their research. :idea:
