The trick would be for Lemming (hope he is ok too) to create a spam usergroup which has no permission to post, and a hidden section only visible to moderators & above. Then give moderators the power to move suspected spammers into the spam group, and their posts / threads into the hidden forum. Lemming could then have oversight as the only person actually able to ban those accounts from the spam group as and when he has time to go through them, and remove their posts completely (or restore them if anything was legitimate).
Personally I think telling mods not to ban anyone or remove anything that isn't obvious spam should be enough, but if there is a historical concern on the forum about moderators and what that would do to the board then imo the above suggestion would solve it (and should be pretty easy to implement).
