SAN FRANCISCO, California (AP) -- A California woman whose doctor says marijuana is the only medicine keeping her alive is not immune from federal prosecution on drug charges, a federal appeals court ruled Wednesday.

The case was brought by Angel Raich, an Oakland mother of two who suffers from scoliosis, a brain tumor, chronic nausea and other ailments. On her doctor's advice, she eats or smokes marijuana every couple of hours to ease her pain and bolster a nonexistent appetite as conventional drugs did not work.

The Supreme Court ruled against Raich two years ago, saying that medical marijuana users and their suppliers could be prosecuted for breaching federal drug laws even if they lived in a state such as California where medical pot is legal.

Because of that ruling, the issue before the 9th U.S. Circuit Court of Appeals was narrowed to the so-called right to life theory: that marijuana should be allowed if it is the only viable option to keep a patient alive.

Raich, 41, began sobbing when she was told of the decision and said she would continue using the drug.

"I'm sure not going to let them kill me," she said. "Oh my God."

Man, some of the things you hear about drugs laws coming out of America really make you wonder...

thats a real bummer. She needs to move more north up to humbolt county. Everyone is rich and no one has a bank account if you get my drift.

I would have posted about Angel a long time ago but I assumed everyone that smokes had probably heard about her she has been fighting the government for many years and her story is one of millions in this country but one of the most well known for her court battles.

And yes the US Gov tells her and millions of other citizens every year that you must live in agony be crippled up and some even die all because THEY SAY SO.

It always amazes me how that most people care nothing about fighting these laws and the last time I checked none of us gets out of life alive so these laws can possibly effect so many of us sooner or later

Even more amazing is our heartless Federal Gov who sends people every year to prison who are in pain and some are crippled in wheelchairs or bedridden and some dying who are all in there for one reason only growing their own (no sales) and using Medical Cannabis.

A major roadblock to overcoming the regressive marijuana laws in the US for both medicinal and recreational use is the Americal Medical Association.

"The following statement, recommended by the Council on Scientific Affairs, was adopted as AMA policy by the AMA House of Delegates at the 2001 AMA Annual Meeting:
The AMA calls for further adequate and well-controlled studies of marijuana and related cannabinoids in patients who have serious conditions for which preclinical, anecdotal, or controlled evidence suggests possible efficacy and the application of such results to the understanding and treatment of disease; (2) The AMA recommends that marijuana be retained in Schedule I of the Controlled Substances Act pending the outcome of such studies."

Now, this statement was issued in 2001 but their stance hasn't changed much since the Stone Age (pun intended). Meanwhile, how many drugs of not merely questional efficacy but downright fatal side effects has the Federal Drug Administration (FDA) approved since medicinal marijuana was first considered? Any tort lawyer could give you a complete list.

I won't get on my soapbox about the pharmaceutical manufacturers, but as soon as they can make marijuana profitable for them, it'll be prescribed for everything on down to extrapyramidal movement disorders. (Be honest, who ever heard of "restless leg syndrome" until they invented a pill for it?)

Meanwhile, the generation that was going to change the world turned off, tuned out, and dropped back in again, and most of them vote Republican. For those of us who remained true to the cause, dude the referrendum was yesterday. Alright, no one ever claimed it improved short term memory.

In short, the AMA has no balls, the drug companies have no incentive, and the government has neither.

All in all it comes down to money. If someone can obtain pain relief without having to use a manufactured prescription drug, developed by a pharmaceutical company whose only existence is too make money. Of course a government will not support them. These companies are no doubt backed by governments who benefit from the pharmaceutical companies profit margins.

As long as the old lady stays here in California shes fine. The feds wont waste their time with personal use and the local or state cops cant touch her. The feds have been busting up medical clinics though. Asthma cure- I can personally back that up as well. :wink:
